PROTECTIONS AGAINST DISCRIMINATION

WHEREAS, the recent decision of the U.S. Supreme Court in the Grove City case has dramatically restricted the protections against sex discrimination provided by Title IX of the 1972 Educational Amendments to the 1964 Civil Rights Act by providing that the prohibition against sex discrimination applies only to the specific program for which federal funding is provided; and

WHEREAS, U.S. Justice Department civil rights chief William Bradford Reynolds has said that a similar restrictive interpretation will be given to the protections against race and handicap bias contained in Title Vl of the 1964 Civil Rights Act and Section 504 of the 1973 Rehabilitation Act, respectively; and

WHEREAS, institution-wide protections against sex, race, and handicap discrimination are essential to the provision of equal opportunity in American higher education for faculty, staff, and students alike:

RESOLVED, that the American Federation of Teachers, AFL-CIO, will support legislation to explicitly establish institution-wide coverage for Title IX and Title Vl of the 1964 Civil Rights Act and Section 504 of the 1973 Rehabilitation Act.
