COLLECTIVE BARGAINING IN PRIVATE COLLEGES AND UNIVERSITIES

WHEREAS, the Supreme Court decision in the Yeshiva case opened the door to the denial of collective bargaining rights to faculties at private colleges and universities; and

WHEREAS, numerous private colleges and universities have subsequently sought to deny collective bargaining rights to faculty organizations and to decertify existing faculty unions; and

WHEREAS, the National Labor Relations Board has supported claims by college and university managements that their faculties are not eligible for collective bargaining rights; and

WHEREAS, the effect of these developments has been to impair faculty unionism in the private sector and to threaten its development and growth in the public sector as well:

RESOLVED, that the American Federation of Teachers supports and vigorously pursues the enactment of federal legislation that guarantees the right of private college and university faculties to unionize.
